The business officer’s role as compliance officer has grown increasingly important as independent schools face more and ever-changing rules and regulations. Additionally, business officers risk management responsibilities dictate that they institute policies, procedures, and best practices to protect their schools from liability. From background checks on summer camp counselors to policies required of the Board of Trustees to student discipline, there are many potential pitfalls. This seminar will explore these many areas and offer strategies to protect the school.

*The seminar on January 8th, 2009 in San Diego, CA will focus specifically on California state law.

This session will review common areas of liability for independent schools and offer solutions to mitigate risk, including summer camps, background checks of parents and volunteers, and background checks of third party personnel.

10:15 - 11:45   Think Guidestar! The New Form 990
Schools will file the new IRS Form 990 after fiscal year 2008-09. This session will explain the changes to the form and offer suggestions for how can schools best prepare for the new form, including opportunities for marketing the school to donors and others who may view the Form 990.

12:45 - 2:00   Word of Mouth: Best Practices in Faculty Recommendations
Faculty recommendations are an accepted part of the independent school world, but many schools do not understand what the law requires and what the law allows in terms of providing and checking references. This session will examine best practices for providing and checking references, and the implications for the industry of following such policies.
2:00 - 3:00   Keep Them on Board: Issues for Trustees
Sophisticated board members want to understand the legal and ethical requirements of their service to a school, and know that they’re covered if something goes wrong. This session will review the necessary elements of Directors and Officers’ insurance policies to protect board members, the policies required of a board, such as document destruction and whistleblower policies, and what to do in sticky situations, such as when the board’s bylaws conflict with actual practice.

3:15 - 4:30   Kids Just Aren’t What They Used to Be (and Neither are Their Issues)
With the combination of an increasingly litigious society and consumer parents with high expectations, independent schools are seeing more legal action related to students. This session will examine the trend in student legal issues, including discipline, reporting of disciplinary infractions on the common application for college, off-campus behavior, reasonable accommodation, failure to educate, and helicopter parents.
